- January 12, 2024. Maria Guadalupe Maldonado, Individually and as Representative of the Estate of Juan Maldonado, Juan Carlos Maldonado, Daniel Maldonado and Joanna Maldonado v. Union Pacific Railroad Company, Cause No. 2020DCV0807. Wrongful death case in the County Court at Law # 3. THe jury found that the railroad crossing was not an extra hazardous crossing at the time of Juan Maldonado’s collision and awarded no damages.

Wrongful death case in the 171st Judicial District Court. The jury determined that Defendant’s negligence was the proximate cause of the occurrence in question and awarded Plaintiffs $20,000 each for the loss of care, maintenance, support, services, advice and counsel that she would have received fromAnnette Martinez had she lived. The jury also awarded Plaintiff Joanna Cangialosi $100,000 for physical pain and mental anguish suffered in the past and $100,000 for future physical pain and mental anguish and awarded C.C., a Minor Child $10,000 for past physical pain and mental anguish and $10,000 for future physical pain and mental anguish

The jury determined that Defendant was responsible for the death of Maria Elena Sernas and awarded actual damages of $138,800.00 and exemplary damages of $300,000.00.
